Ukrainasta paenneet voivat hakea nyt tilapäistä suojelua
EU teki viime viikolla historiallisen päätöksen ja otti ensimmäistä kertaa käyttöön tilapäisen suojelun direktiivin vastauksena Ukrainan sodasta johtuvaan pakolaiskriisiin.
Tilapäistä suojelua myönnetään EU-tason päätöksen mukaisesti 24.2. lähtien Ukrainasta paenneille
- Ukrainan kansalaisille ja heidän perheenjäsenilleen
- Ukrainasta kansainvälistä suojelua saaneille henkilöille ja heidän perheenjäsenilleen
- muille Ukrainassa pysyvästi asuneille, jotka eivät voi palata kotimaahansa.
Suomessa tilapäistä suojelua annetaan myös
- Ukrainan kansalaisille ja heidän perheenjäsenilleen, jotka ovat paenneet Ukrainasta vähän ennen 24.2. eivätkä voi konfliktin seurauksena palata
- muille Suomessa jo oleskeleville tai Suomeen saapuneille Ukrainan kansalaisille ja heidän perheenjäsenilleen
- Ukrainassa laillisesti (muutenkin kuin pysyvästi) oleskelleille EU:n ulkopuolisten maiden kansalaisille, jotka eivät voi palata kotimaahansa.
Tilapäistä suojelua haetaan poliisilta tai rajaviranomaiselta, aivan kuten turvapaikkaakin. Hakemuksen käsittelyn ajan sinulle tarjotaan vastaanottopalvelut kuten turvapaikanhakijoille.
Tilapäistä suojelua saaneelle tarjotaan vastaanottokeskusten kautta saman tasoiset majoitus- ja sosiaalipalvelut kuin turvapaikanhakijoille sekä terveyspalvelut kuin kuntalaiselle. Asumisen voi järjestää myös itse ns. yksityismajoituksessa. Tilapäistä suojelua saaneilla on välittömästi päätöksen saatuaan oikeus tehdä töitä.
Tilapäisen suojelun hakeminen ei estä hakemasta myös turvapaikkaa, mutta jos tilapäistä suojelua myönnetään, useimmiten turvapaikkahakemuksen käsittely keskeytetään siksi ajaksi, kun oleskelulupa tilapäisen suojelun perusteella on voimassa.

People fleeing from Ukraine may now apply for temporary protection
EU made a historical decision last week and adopted The Temporary Protection Directive for the first time as a response to the current refugee crisis in Ukraine.
Temporary protection will be granted in accordance with the EU decision to those who have fled Ukraine from 24th of February onwards:
- To citizens of Ukraine and their family members
- To those who have obtained international protection from Ukraine and to their family members
- To other people who have been permanently residing in Ukraine and cannot return to their home country
In Finland temporary protection will be granted also to:
- Citizens of Ukraine and their family members, who have fled from Ukraine shortly before 24.2. and cannot return to Ukraine due to the conflict
- Other citizens of Ukraine and their family members that are residing in Finland or have arrived in Finland
- Non-EU citizens that are residing in Ukraine legally (also in other ways than permanently), and who cannot return to their home country.
One has to apply for temporary protection at the police or the border control authorities, the process is the same as when seeking asylum. You will be provided the same reception services as asylum seekersduring the application process.
Those who are granted temporary protection will be provided the same standard of accommodation and social services as asylum seekers and the same health care services as local residents. It is also possible to organise accommodation via so called private accommodation. Those who are granted temporary protection will have the right to work immediately.
Seeking temporary protection does not prevent you from applying for asylum, however if you are granted temporary protection, the Finnish Immigration Service will in most cases suspend the processing of your asylum application for as long as your residence permit issued on the basis of temporary protection is valid.

Temporary protection for those fleeing Ukraine
In some cases it is better to apply for asylum. Especially if the applicant has individual grounds for international protection, you can call the Finnish Refugee Advice Centre’s legal advice phoneline (free of charge) +358 9 2313 9325. It is open on weekdays from 10 am to 12 am. You can also send a message to neuvonta@pakolaisneuvonta.fi.
